Title 19 (Medicaid) Planning

Title 19 (Medicaid) Planning

Are you or a loved one thinking about the possibility of a nursing home?  If so, you probably have many questions.  Which nursing home am I going to use?  How will I pay for it?  Will I have to sell my house in order to pay for nursing home care?  What governmental assistance programs are there, and how do I qualify?  At Nommensen Law Offices, we are experienced in this area of law.  We can answer your questions, and advise you as to the applicable laws.

Title 19 (also called “Medicaid”) is the government program that pays for the long-term care of certain individuals.  Nursing home costs are tremendously expensive, and without this form of governmental assistance, many of us would be without care at the end of life.  Medicaid assistance, however, is provided only to those individuals who are “eligible”.  You do not necessarily have to be “poor” to be eligible.  The eligibility requirements can be very confusing and complex.  There are look-back periods, asset limits, income caps, transfer penalties, waiting periods, disqualifying transfers, exempt transfers, countable assets – the list goes on and on.  This is one area where the experience of a qualified elder law attorney is truly invaluable.  We can help you determine whether you are eligible, and if not, what steps you can take to become eligible and protect as much of your assets as possible in the process.
